The Centre for Alcohol Studies (CAS) is pleased to make available an unofficial English translation of the Alcoholic Beverage Control Act B.E. 2551 (2008). This document serves as a resource for researchers, international organizations, and the general public to understand the legislative framework governing alcohol control in Thailand. This Act, which entered into force in February 2008, established the primary mechanisms for reducing alcohol-related harm through restrictions on access, marketing, and consumption.
Key Highlights of the Act:
Governance Structure: The Act establishes the "National Alcoholic Beverage Policy Committee," chaired by the Prime Minister, to formulate national policy. It also establishes the "Alcoholic Beverage Control Committee," chaired by the Minister of Public Health, to oversee implementation and recommend specific rules.
Sales Restrictions
Prohibited Methods: The Act prohibits selling alcohol via automatic vending machines, hawking, or using discounts/promotions for sales purposes.
Prohibited Persons: Sales are strictly prohibited to persons under 20 years of age and those who are intoxicated to the point of losing consciousness.
Prohibited Locations: Sales are banned in temples, public health service units, public offices, dormitories, education institutions, petrol stations, and public parks.
Consumption Zones: Consumption of alcohol is prohibited in specific zones, including temples, public offices, schools, and petrol stations, with limited exceptions for private living areas or authorized clubs.
Advertising Control: Section 32 prohibits advertising that displays the product or packages, or claims properties to induce drinking. Manufacturers may only display symbols for the purpose of giving information or "social creative knowledge" without showing the alcoholic beverage itself.
Treatment and Rehabilitation: The Act provides the right for alcoholics to apply for treatment and rehabilitation support from the Office of the Alcoholic Beverage Control Committee.
